Responsibility

Cyngor Gwynedd, jointly with Isle of Anglesey County Council, is responsible for your personal information.

Why we need your information

Personal information is shared for the purpose of supporting the effective development, welfare and wellbeing of children and young people aged 0 – 25, including those with additional learning needs (ALN), and to support their families and carers. The aims are:

  • to ensure that all learners, including those with ALN are supported to overcome barriers to learning and achieve their full potential
  • to improve the planning and delivery of support for learners between 0 and 25 years of age, with ALN
  • placing learners needs, views, wishes and feelings at the heart of the process
  • focusing on the importance of identifying needs early and putting in place timely and effective interventions which are monitored and adapted to ensure that they deliver the desired outcomes.

Lawful basis

The lawful basis we rely on to process your personal data is article 6(1)(c) and 6(1)(e) of the UK GDPR, which allows us to process personal data when this is a legal obligation or as part of our public task.

The relevant legislation is the Additional Learning Needs and Education Tribunal Act (Wales) 2018.

If the information contains special category data, such as health, religious or ethnic information the lawful basis we rely on to process it is Article 9(2)(g) of the UK GDPR, which also relates to our public task and the safeguarding of your fundamental rights and Schedule 1 part 2(6) of the DPA 2018 which relates to statutory and government purposes.

The health board will also rely on Article 9(2)(h) health and social care purposes.

Categories of personal information we process

Pupil personal data

• Personal identifiers such as name and address.

• Characteristics such as gender, ethnicity, sexual orientation, unique pupil number, language, nationality, country of birth and free school meal eligibility.

• Assessment information (such as results of Welsh national tests, statutory assessments and on-going teacher assessment).

• Relevant health and medical information.

• Additional Learning Needs and disability information.

• Details of relevant behavioural issues or exclusions.

• Legal access to the pupil and any court orders indicating access rights.

 • Details of any relevant social services involvement with the family.

• Child Looked After status (if applicable).

Parents and others personal data

• Basic personal information (such as name, address, date of birth, contact details, place of work etc.).

• Basic personal information of relevant relatives (such as name, address, contact details, relationship to the child etc.).

• Legal access to the pupil and any court orders indicating access rights.

• Details of any relevant social services involvement with the family (this may include information relating the parents, siblings and other household or family members).

Who else will receive the information  

We share the information with Betsi Cadwaladr University Health Board, schools, nurseries, Careers Wales, Grŵp Llandrillo Menai and other education partners, and Gwynedd and Anglesey Youth Justice Service. We will only do this where it is relevant and appropriate.

How long we keep it

We will keep the information until your child is 35 years of age.
